The UN Committee on the Elimination of Racial Discrimination (CERD) on Wednesday called for an end to attacks directed against or indiscriminately affecting civilians in Lebanon. Acting under its Early Warning and Urgent Action Procedure, the Committee warned that no derogation from the prohibition of racial discrimination is permitted during armed conflict.
Under the International Convention on the Elimination of All Forms of Racial Discrimination, which Israel ratified in 1979, States must prevent and eliminate racial discrimination, including (as interpreted by CERD) against non-citizens under a State’s “effective control.” Large‑scale displacement in a conflict zone can raise concerns under CERD when the effects fall disproportionately on a particular ethnic or national group, or when official statements dehumanize affected populations.
CERD voiced concern over the civilian toll resulting from Israeli military operations in its war against Hezbollah. It again urged Israel to rescind “blanket displacement and evacuation orders” and to halt the forcible transfer of people across southern Lebanon. UN officials previously questioned whether these orders met the effectiveness requirements of international law. CERD reported that more than 360,000 people remained displaced at the end of July.
The warnings, like this one posted on X earlier this month by the IDF’s Arabic-language spokesperson, call for immediate evacuation and warn that anyone who remains near military targets “exposes their life to danger.” CERD noted that more than 70 such orders were issued in March, affecting nearly 190 towns and villages.
Hezbollah is an Shia Islamist paramilitary group based in Lebanon, which Israel labels as an Iranian-backed terrorist organization. Article 49 of the Fourth Geneva Convention reflects customary international humanitarian law prohibiting individual or mass forcible transfer of civilians, except when an evacuation is for the security of the civilians or for “imperative military reasons.”
The Committee also noted that Hezbollah strikes into Israel have caused civilian casualties and damage to civilian infrastructure. The IDF claims that rocket barrages and attempted infiltrations from Lebanon have also displaced Israeli civilians in the north.
Israel claims that its military operations target Hezbollah military installations embedded in civilian areas of southern Lebanon. Israel justifies its evacuation orders as precautionary measures compliant with international law. Separately, CERD has noted that displacement patterns in southern Lebanon correlated with demographic changes that fall within its formal monitoring mandate.
