Jurist Turkish court releases pop star Gulsen from pre-trial detention

A Turkish court ordered pop star Gülşen Çolakoğlu to be released Monday from pre-trial detention and to be placed under judicial control on the condition that she does not leave the residence. Gülşen was released from Bakırköy Closed Women’s Prison at around 14:40 PM local time and went to her residence in a private vehicle.

Gülşen was arrested following statements that she made to students of Imam Hatip High School at a concert she gave on April 30. The Istanbul Chief Public Prosecutor’s Office alleged that the statements made by Gülşen on stage came within the scope of Article 216 of the Turkish Penal Code, which prohibits a person from “publicly provok[ing] hatred or hostility in one section of the public against another section which has a different characteristic based on social class, race, religion, sect or regional difference”

Following her arrest, her lawyer Emek Emre demanded that her detention be lifted. The petition stated that Gülşen’s arrest was unjust as elements of the crime for which she was arrested had not been fulfilled, as her words did not pose an immediate danger to public safety

The court agreed to her release under judicial control, but it was warned that she would be arrested if she did not comply with the judicial control measures. Her lawyer stated, “[w]e are very happy about the release. We have been through a sad and worrying process since Thursday last week.”
