Jurist Rights group warns against increased Russia attacks on Sumy City in Ukraine

Civilians in Sumy City, Ukraine, are being killed and injured by “increased unlawful attacks” from Russia involving “Grad rockets,” Amnesty International reported on Tuesday.

Amnesty International called for any attacks using Grad rockets to be “investigated as war crimes” due to their inaccurate nature. Russia struck Sumy City on June 3, killing “at least seven civilians” and injuring several others. This is part of a wider pattern of escalation, with 80 to 120 shellings taking place across the Sumy province daily, according to the Ukrainian authorities.

An airstrike in Sumy on April 13 killed 34 civilians and injured 117. Sumy is located in northeastern Ukraine and is roughly 30km from the Russian border. Russian troops have been advancing on the region within the past month, leading to the evacuation of hundreds of settlements. Vladimir Putin, President of Russia, recently stated that he would not rule out taking Sumy, as they “pose a constant threat to us.”

The 122m rockets used in the attacks on Sumy are launched using the BM-21 Grad multiple launch rocket system. They are inaccurate and imprecise, as they are unguided and designed to cover a wide area. This means that they are very likely to cause harm to civilians when used in populated areas. Brian Castner, Amnesty International’s Head of Crisis Research, stated that “inherently inaccurate weapons must not be fired at areas densely populated with civilians.”

Article 51(4) of Additional Protocol I to the Geneva Convention prohibits indiscriminate attacks, defined as attacks which are “of a nature to strike military objectives and civilians… without distinction.” This principle is also included in Article 8(b)(xx) of the Rome Statute. Multiple indiscriminate attacks have been recorded in Ukraine since the beginning of the conflict with Russia in 2022, according to Amnesty International. The International Criminal Court opened an investigation into alleged war crimes in Ukraine in March 2022.
