Jurist Rights group raises concern over China targeting pro-independence Taiwan citizens

Human Rights Watch said Friday that the Chinese government is investigating the Taiwanese legislator Puma Shen Pao-Yang (沈伯洋) for the crime of “separatism,” infringing upon his basic human rights.

The announcement marks the first known application of China’s recently issued judicial guidelines targeting “Taiwan independence separatists,” representing a significant escalation in Beijing’s legal pressure on Taiwanese citizens. The investigation, opened by the Chongqing Municipal Public Security Bureau, targets Shen for his role in co-founding Kuma Academy, which Chinese authorities characterize as a “pro-Taiwanese independence separatist organization.”

Since the Chinese Civil War, China asserts its “One-China Principle,” claiming sovereignty over Taiwan despite having never governed it. Taiwan has developed as a separate, self-governing democracy with its own legal system and political institutions. This investigation represents Beijing’s effort to extend its legal jurisdiction across Taiwan.

The investigation follows China’s pattern of increasing pressure on Taiwanese figures. In October 2024, China imposed sanctions on Shen, banned him and his family from entering China, and later targeted his father’s business. Shen now joins a growing list of Taiwanese figures designated as “die-hard pro-Taiwan independence elements.” Maya Wang, associate Asia director at Human Rights Watch, stated:

The Chinese government’s investigation of Puma Shen reflects escalating efforts to intimidate Taiwanese people about exercising their rights through the cross-border application of abusive Chinese laws. Beijing is reaching beyond its borders and seeking to declare certain lawful speech and activities as off-limits for Taiwan’s people.
The legal action against Shen follows other high-profile cases involving Taiwanese citizens. In August 2024, Chinese authorities sentenced Taiwanese activist Yang Chih-yuan to nine years in prison for “separatism,” while in February 2025, Taiwanese publisher Li Yanhe received a three-year sentence for “inciting secession” for publishing books in Taiwan.

Consequently, the Chinese government holds that Shen and other Taiwanese citizens are liable under China’s Criminal Law for political activities conducted in Taiwan. This represents an assertion of extraterritorial jurisdiction that legal experts say contradicts international law norms.

The investigation, while a significant escalation, faces practical limitations. Since Shen resides in Taiwan, any trial would likely proceed in his abscense. However, the charges carry severe consequences, including potential death penalty for “especially serious” crimes and the risk of extradition through third countries.

Even though China claims the legal authority to prosecute cases involving Taiwanese citizens, this approach has drawn international criticism and may further complicate cross-strait relations. The international response to these legal actions and their impact on regional stability remain to be seen.
