Jurist Rights group condemns Uganda law for persecuting LGBT people

A news report released by Human Rights Watch (HRW) on Monday indicated that the Ugandan government has perpetrated violence against LGBTQ+ people, their families, and supporters since Uganda’s 2023 Anti-Homosexuality Act was enacted.

The report highlights abuses instigated and enabled by Uganda’s government, its institutions, and parliamentary members. The report found that these abuses by the government have added to pre-existing obstacles, abuse, violence, and violations towards the LGBTQ+ community and have negatively impacted their lives. Misinformation spread by the government and its figures through social media has led to an increase in violence and persecution towards Uganda’s LGBTQ+.

The Anti-Homosexuality Act was passed on May 26, 2023, by the Parliament of Uganda and was upheld by the African country’s Constitutional Court. The judges had held that the Act “does not violate fundamental rights to equality and non-discrimination, privacy, freedom of expression, or the right to work for LGBT people.” However, local LGBT advocacy groups operating under the Strategic Response Team (SRT Uganda) stated that Ugandan LGBT people were subjected to blackmail, evictions, displacement, discrimination, loss of employment and homes, mob attacks, interference with health services, torture, inhumane and degrading treatment and violence, such as physical, sexual and psychological violence.

In 2024, Ugandan LGBT advocacy group Convening for Equality (CFE) documented violations against the LGBT community in Uganda after the enactment of the 2023 Act. Amnesty International released a report describing the widespread gender-based violence against the LGBTQ+ community in Uganda, highlighting the violence the LGBTQ+ community faces in Uganda.

President Yoweri Museveni and various political figures had gathered in Uganda to accept the 2023 Act against LGBTQ+, creating an anti-LGBT movement. Throughout 2022 and 2023, LGBT organisations and supporters were silenced by Ugandan authorities. Anti-LGBT law is also found in Uganda’s Penal Code. The Anti-Homosexuality Act punishes homosexuality with a life sentence and includes supporters “promoting” it, such as healthcare, housing, and financial support.

HRW says that Uganda has a responsibility to end the persistent violence against the LGBT, recommending that Ugandan authorities end their “clampdown” on LGBT and rights groups, refrain from fuelling hate speech, deal with violence through the justice system and repeal both the 2023 Anti-Homosexuality Act and the provisions of Uganda’s Penal Code that criminalises homosexuality.

Part II, Section 3 of Uganda’s Prevention and Prohibition of Torture Act, 2012 prohibits torture, inhumane and degrading treatment. This is reinforced by Articles 24 and 44 of the Ugandan Constitution, which respect human dignity and put a duty on the government to protect its citizens from inhumane treatment as well as prohibit derogation from human rights and freedoms.

Uganda is one of 32 countries in Africa that criminalise being a part of the LGBT community or a supporter. Anti-homosexuality laws were historically introduced under British imperial and colonial rule during the late 19th century, which shaped Uganda’s treatment towards the LGBT, and, in recent times, Western Evangelicals have promoted anti-LGBT rhetoric in Africa.
