Jurist Rights group calls for reversal of convictions in Tunisia conspiracy case

Amnesty International on Friday called for Tunisian authorities to revoke the “unjust convictions and sentences” in the conspiracy case against several activists, politicians, and lawyers, calling their detention a blow to human rights.

Sara Hashash, the deputy regional director for the Middle East and North Africa at Amnesty International, called for an immediate “quash” of the unjust sentences and an immediate release of all defendants. Hashash called their arrests an encouragement to “growing authoritarianism” and a “full blown human rights crisis.”

Hashash noted that since the beginning, the authorities have deliberately compromised the detainees’ rights to a fair trial. According to Hashash, the court has violated due process rights by insisting on holding the trial remotely and depriving the detainees of the right to be in the courtroom.

Additionally, the rights group asserted that the government has used the justice system to eliminate political dissent through the criminalization of peaceful opposition and repeatedly targeted attorneys representing the detainees.

The “conspiracy case” in Tunisia against 37 opposition figures, lawyers, and activists has drawn severe criticism after prison terms of up to 66 years were given in April 2025. Several prominent opposition leaders are among the individuals sentenced, including Khayyam Turki, Jaouhar Ben Mbarek, and Nouredinne Bihri.

Earlier in November, Human Rights Watch (HRW) urged Tunisian authorities to overturn the convictions, arguing that the prosecutions of the opposition figures represented an erosion of judicial independence. HRW criticized the case for violating basic fair-trial guarantees, including excessive pretrial detention and rushed proceedings that created a limited window for defense.

According to UN High Commissioner for Human Rights Volker Türk, the trial has raised serious concerns over its political motivations and the use of counter terrorism legislation to silence dissent. Türk concluded that the trial was “marred by violations of fair trial and due process rights,” becoming a setback to justice and the rule of law.

On the other hand, Tunisian President Kais Saied criticized a European Parliament resolution calling for the release of the detainees as an interference in the country’s domestic issues. The EU Parliament resolution condemned the arbitrary detention of lawyer and commentator Sonia Dahmani, calling for her immediate release.

The resolution also urged Tunisia to repeal Decree-Law 54 of 2022, a law against cybercrime that includes potential prison sentences for people spreading misinformation on the internet. According to rights groups, this law has been widely used to silence and arrest critics of the government.
