The Constitutional Court of the Republic of Lithuania declared the provisions of the Law on the Legal Status of Foreigners passed in 2021 unconstitutional on Wednesday. According to provision 1408(3), asylum seekers were obliged to be accommodated in designated places without being granted the right to move freely within the territory of the Republic of Lithuania. The duration of such accommodation could be up to six months. Legislators enacted the provision to stop migrants crossing the border into EU member states.
In the decision, the judge found that this provision was contrary to Article 20 of the Constitution, which provides the inviolability of the freedom of the enshrined person. The court recognized that “a person’s freedom is not absolute and can be restricted when necessary” while also stressing that this kind of restriction must be done within certain limits. The grounds and conditions for such restrictions must be clearly and comprehensively set out in the law, and “the measures limiting a person’s liberty must in all cases ensure that they are compatible with respect for human dignity.”
While pronouncing the verdict, the presiding judge stated that legislators had restricted “the right to freedom more than was necessary.” However, the petitioners held that they were meant to ensure public order to protect the state border.
Lithuania’s migrant population has been steadily increasing. In 2021, over 4,000 migrants, which were predominantly Iraqi citizens, entered the Baltic Republic.
