ICC President Tomoko Akane addressed the UN General Assembly Monday, calling on the 193 member-nations to take “concrete actions” on sanctions imposed on the ICC by US President Donald Trump on October 9.
Nine of the 18 judges appointed to the court, including Akane, are under sanctions for fulfilling their duties to the court. Akane delivered their speech to the UN General Assembly due to the sanctions.
On October 9th, ICC Judge Navi Pillay was awarded a Nobel Peace Prize for her efforts to promote international law through their work as United Nations High Commissioner for Human Rights (OHCHR) and their work for the UN Independent International Commission of Inquiry on the Occupied Palestinian Territory. On the same day, President Trump imposed sanctions on the ICC, banning US transactions with the court, suspending access to US dollars, financial services, and technology. US Secretary of State Marco Rubio announced the imposition of full sanctions on the ICC, stating “either the ICC will end its threats, or we will end the ICC.”
“The contrast [of the events on October 9] could not be starker: on the one hand, global recognition of the value of international justice; on the other, an attempt to subdue the institution that embodies it,” said Akane.
Previously, President Trump had imposed sanctions on ICC prosecutor Fatou Bensouda alongside senior official Phakiso Mochochoko in 2020 after the court had announced it was opening investigations into the alleged perpetration of war crimes by US personnel in Afghanistan, although this was later revoked by President Joe Biden via Executive Order 13928.
The ICC and UN are bound by Article 3 of the 2004 Relationship Agreement, which states that ” they shall cooperate closely, whenever appropriate, with each other and consult each other on matters of mutual interest…” Akane reminded the UN General Assembly of the mutuality of their operating agreement in relation to the US sanctions.
Despite the US sanctions, the ICC continued to commence judicial and prosecutorial proceedings. More than 23,500 victims went before the court during the 2026 reporting period, as evidenced by the annual ICC report to the UN.
