International Criminal Court (ICC) Judges Kimberly Prost, Solomy Bossa, and Reine Alapini-Gansou on Wednesday sued US President Donald Trump for overstepping the boundaries of his authority in issuing sanctions to court officials involved with investigating crimes in Afghanistan and Palestine.
The suit, filed in US District Court for the Southern District of New York, challenges Trump’s executive order issued in February 2025 that declared a national emergency and sanctioned prosecutors and judges at the ICC involved with the “baseless” issuance of an arrest warrant for Israeli Prime Minister Benjamin Netanyahu and the past decision to open a, now dropped, case into alleged war crimes committed by US troops in Afghanistan.
In their complaint, the judges contend that the order oversteps statutory authority by violating US obligations under international law, contradicting acts of Congress, and exceeding the president’s authority under the International Emergency Economic Powers Act and the National Emergencies Act. Additionally, the suit asserts that the order violates the 5th Amendment of the US Constitution by authorizing a deprivation of property without due process, and is arbitrary and unlawful, therefore violating the Administrative Procedure Act.
Prost of Canada, Bossa of Uganda, and Alapini-Gansou of Benin are among several judges, ICC prosecutors, and civil organizations facing the effects of the sanctions, including travel bans, frozen assets, restricted access to tech platforms, and cancelled bank accounts. Five prior suits have been filed against the order, but this marks the first challenge in which an ICC judge has been involved.
Justifying the sanctions, Trump asserted that neither the US nor Israel is a party to the Rome Statute and therefore not within the authority or control of the ICC. He additionally stated that the ICC’s “maligned” conduct threatened to infringe on US sovereignty, and that anyone involved in the conduct posed an “unusual and extraordinary” risk to the country’s national security.
Established by the Rome Statute in 2002, the ICC has authority over parties who have committed genocide, war crimes, crimes against humanity, and crimes of aggression. Although the US is not a party to the Rome Statute, it has supported the court in other investigations.
Trump’s order has been widely contested and condemned by human rights and legal organizations for weakening the effectiveness of the international justice system and unnecessarily burdening judges with the task of rendering just but unfavorable decisions.
“Targeting international judges for carrying out their judicial duties is an unprecedented attack on judicial independence and the rule of law,” said James A. Goldston, Executive Director of the Open Society Justice Initiative, in a press release.
