The International Criminal Court (ICC) on Wednesday condemned the US for its latest sanctions against Tomoko Akane, the president of the court, and Abdoulaye Seye, senior trial lawyer at the Office of the Prosecutor. The court reiterated its steadfast commitment to upholding accountability and protecting victims of international crimes.
The court’s statement described the sanctions as a “flagrant attack” against its judicial independence, hindering the performance of its mandate under the Rome Statute. It warned that the sanctions targeting its personnel have placed the international legal order at risk, as the measures sought to deter the court from applying the law; they limit victims’ ability to seek redress and justice.
The latest sanctions expanded their coverage to nine of the 18 ICC judges, two deputy prosecutors, former prosecutor Karim Khan and one staff member.
In response to the sanctions against the Japanese judge, the Japanese Prime Minister Sanae Takaichi said at a Wednesday press conference that the situation was “very unfortunate,” indicating her plan to continue communication with relevant countries, including the US. On the same day, the Japanese foreign ministry added that the country has “consistently supported the ICC” and remains committed to strengthening the international rule of law. The UN Secretary-General António Guterres also expressed his serious concern about the sanctions.
In a Thursday statement, France also reaffirmed its “unwavering support” for the ICC, condemning all threats and coercive measures against the ICC.
On Tuesday, US Secretary of State Marco Rubio announced the newest round of sanctions under President Donald Trump’s executive order. He said Akane and Seye had directly engaged in investigations and prosecutions against government officials from countries outside the court’s jurisdiction, calling it a “dangerous precedent.” Quoting media reports, UN News confirmed that Seye has been investigating Israel’s role in the West Bank, such as funding and providing weapons to settlers.
The sanctions followed Rubio’s diplomatic campaign to dismantle the ICC, beginning in mid-July. In an op-ed published in the Wall Street Journal, he announced the country’s intention to work with its allied government to take the court apart “brick by brick, if necessary.” The campaign is, however, facing challenges in courts from human rights groups, Palestinian-related advocacy groups, and ICC judges. They similarly argued that Trump exceeded his authority to issue the executive order, the sanctions violated their First and Fifth Amendment rights, and the sanctions are arbitrary and unlawful under the domestic Administrative Procedure Act.
Established in 2002, the court has 125 state parties. They have at least twice stated their support for the court’s operation in June 2024 and February 2025.
