Jurist UN Security Council condemns M23 offensive in DRC

The UN Security Council on Friday unanimously adopted a resolution condemning the ongoing offensive by M23 rebels in the eastern Democratic Republic of the Congo (DRC) and urging the Rwanda Defence Forces (RDF), which supports the rebel group, to withdraw immediately from Congolese territory.

According to the UN, fighting in the DRC has intensified since January, with M23 fighters reaching the North and South Kivu provinces and capturing the cities of Goma and Bukavu. The crisis has led to a surge in civilian casualties and displacement, which has also affected neighbouring countries such as Burundi.

Since February, 40,000 Congolese refugees have crossed into Burundi, with over 9,000 arrivals recorded on a single day this week. The UN estimates that there are currently over 500,000 internally displaced persons in eastern DRC, and there will be an influx of 258,000 refugees across Burundi, Rwanda, Tanzania, Uganda, and Zambia.

The Security Council also condemned the use of summary executions, sexual and gender-based violence, recruitment of children, and attacks directed at civilians. According to Bintou Keita, the UN Secretary General’s Special Representative in the DRC, the occupation of North Kivu by M23 rebels has “severely restrained” the UN’s ability to provide life-saving assistance. She reported that the ongoing clashes have hindered access to humanitarian resources. She noted that there are mis- and disinformation campaigns against the peacekeeping mission in the region, and reiterated that the mission in the DRC has a core mandate to protect unarmed individuals impartially.

M23 is a Tutsi-led group backed by the RDF. Since 2021, M23 rebels have launched a series of ongoing military offensives against the government. Humanitarian organizations have recently reported on potential war crimes and atrocities by M23. Earlier this year, the UN High Commissioner for Refugees (UNHCR) launched a fact-finding mission in the DRC, investigating potential human rights violations. The situation further worsened this year as M23 captured further territory across the country. Last week, the UNHCR warned of a “sharply deteriorating” human rights situation in the DRC.
