Jurist UN report finds Afghanistan violated human rights of involuntary returnees

The United Nations released a report on Thursday indicating that the Taliban authorities in Afghanistan committed human rights violations against Afghan refugees who returned to their home country. The UN condemned these abuses and urged authorities to adhere to Afghanistan’s obligations under international law.

The report, conducted by the UN Assistance Mission in Afghanistan (UNAMA) and the UN Human Rights Office, was based on interviews with 49 Afghan nationals who were involuntarily returned to Afghanistan. The most affected groups identified in the report include women and girls, media and civil society workers, as well as former government officials and members of the security forces. These individuals reported to UNAMA that they experienced various human rights violations perpetrated by the Taliban, including torture, ill-treatment, arbitrary arrests, and threats to their personal security.

The UN called on Afghan authorities to comply with international human rights law, to protect the rights of Afghans returning to the country, and to cease the persecution of former political officials and other returnees. Furthermore, it urged member states to conduct individual assessments before returning individuals to Afghanistan and to refrain from sending anyone back when there is a risk of human rights violations. The UN also recommended that states increase financial support to Afghanistan to facilitate the reintegration of returnees and provide safe pathways for Afghans seeking to leave if they face threats of abuse.

According to the UN, the return of Afghan refugees from neighboring countries violated the principle of non-refoulement outlined in Article 33 of the 1951 UN Refugee Convention. This principle guarantees that no one should be returned to a country where they may face torture, degrading treatment or other irreparable harm. The UN previously condemned Germany for not respecting this principle due to its deportation of Afghan nationals despite prevailing unsafe conditions for returnees.

Additionally, the interviewees reported that they faced beatings, detention, and threats of arrest from authorities after returning to Afghanistan, which hindered their ability to work, move freely, and participate in daily life. For instance, former government officials indicated that they have had to go into hiding since their return due to fear of reprisals, despite the Taliban’s promises of amnesty for those who previously opposed them. Another testimony from a TV reporter revealed that she and other women faced a lack of job opportunities and restrictions on their freedom of movement.

The human rights situation in Afghanistan has been a primary concern for the UN since the Taliban regained control of the country in 2021. The Taliban have severely restricted the rights of women and girls, imposing movement restrictions and banning access to education and work. In July 2025, the International Criminal Court (ICC) issued arrest warrants for Taliban leaders for their alleged involvement in the persecution of women and girls. Additionally, the country has been experiencing a rising influx of migrants amid a dire humanitarian crisis characterized by poverty, hunger, and economic collapse.
