UN Special Rapporteur on the situation of human rights in Palestinian territories, Francesca Albanese, on Saturday called for senior EU officials to face prosecution for their alleged complicity in war crimes committed by Israel during its ongoing assault on Gaza. In a series of interviews and reports, Albanese has repeatedly accused EU leaders — particularly European Commission President Ursula von der Leyen and EU Foreign Affairs Chief Kaja Kallas — of aiding and abetting violations of international law by providing political and diplomatic support to Israel.
Albanese’s strong statements come amid mounting evidence and international condemnation of Israel’s military operations in Gaza, which have caused extensive civilian casualties and widespread destruction. According to Albanese, Israel’s actions amount to genocide and the EU’s failure to press Israel to cease its operations or take meaningful action constitutes complicity in these crimes. Further emphasizing that “immunity cannot equate with impunity,” Albanese urged that those responsible for enabling these atrocities, including top EU officials, be held accountable under international law.
A formal complaint has already been filed with the International Criminal Court (ICC) accusing von der Leyen of complicity in war crimes. Albanese labeled the EU’s continued business-as-usual relations with Israel as particularly deplorable, pointing to their failure to use their political leverage to halt the violence. She also criticized Kallas for trivializing the situation in Gaza by describing the conflict as a loss for both sides, which Albanese views as a minimization of the suffering Palestinians have endured.
The humanitarian situation in Gaza has reached catastrophic proportions, with over 50,000 Palestinians killed and nearly 90% of the population displaced. Despite these dire conditions, Israel’s military operations continue, including bombings of UN shelters and food distribution centers. The international community, including the ICJ, has condemned Israel’s actions as unlawful, with some experts suggesting that these acts may amount to genocide.
Albanese has also expressed concern over the involvement of other institutions—such as financial entities, tech companies, and universities—that may be complicit in supporting Israel’s occupation and military actions. She is working on a report to expose these actors and hold them accountable for their role in facilitating violations of international law.
In response, the European Commission defended its position stating that their relations with Israel are grounded in the association agreement, which provides mechanisms for dialogue and expression of concerns. However, Albanese and other critics argue that the EU’s support for Israel in light of mounting evidence of war crimes raises serious legal and moral questions about their role in the conflict.
Albanese has faced considerable pressure in recent months with threats of arrest from Germany and pressure from the US and European pressure or UN to prevent renewal of her appointment. However, she has remained steadfast and defiant in her position and has claimed that the real issue today is the “suppression of critical voices.”
