Jurist South Korea president indicted on insurrection charges

Prosecutors announced Sunday that they have formally arrested and indicted President Yoon Suk Yeol on charges of leading an insurrection, according to local media. With this indictment, Yoon will be detained for six months while he undergoes criminal trial proceedings.

Prosecutors have charged Yoon with leading an insurrection and conspiring with senior military officials to prevent lawmakers from voting in the national assembly. With this indictment, Yoon joins Defense Minister Kim Yong Hyun who was indicted on similar insurrection charges in December and is awaiting trial.

Yoon first was taken into custody on January 15 to be questioned by investigators for his alleged role in leading an insurrection. Prosecutors subsequently sought a formal arrest warrant for insurrection. The arrest warrant was approved last Sunday, and Yoon has remained in pre-trial detention. However, investigators transferred the case to the Seoul Central District Prosecutors’ Office due to Yoon’s lack of co-operation. The prosecution then sought extensions of the detention period to question Yoon, which were denied by the courts. As such, the prosecution filed this formal indictment before his detention period expired.

Yoon has steadfastly denied ordering the arrest of lawmakers when he declared martial law on December 3 and that his declaration of martial law was within his presidential prerogative.

This marks a significant turning point since Yoon’s December 3 declaration of martial law. He was impeached two weeks later and suspended from his presidential duties. Article 65 of the Constitution of South Korea provides that impeachment is not complete until the Constitutional Court of Korea adjudicates the matter within 180 days. The judicial proceedings related to the impeachment are separate from the criminal charges. Yoon, now in prison, still remains president of the country until the court approves the impeachment motion.
