Jurist South Korea former first lady sentenced to 20 months for bribery

The Seoul Central District Court on Wednesday sentenced former South Korea first lady Kim Keon Hee to 20 months in prison for accepting bribes in exchange for political favors.

The court found Kim guilty of accepting luxury gifts, including Chanel bags and a diamond pendant, from officials associated with the Unification Church. In its verdict, the court stated Kim had “exploited her position to seek personal gain” and noted her ability to exert “significant influence” over the former president. Although the Unification Church maintained that the gifts were offered without expectation of return, the judiciary ruled that they were delivered with the intent of securing political influence.

In addition to the prison sentence, Kim was ordered to pay a fine of 12.8 million won and forfeit the diamond necklace in question.

The former first lady was acquitted on two other major charges, including stock manipulation and violations of the Political Funds Act. Citing a lack of sufficient evidence, the court invoked the legal principle of In Dubio Pro Reo (“When in doubt, for the accused”), emphasizing that criminal liability cannot be established without definitive proof. Prosecutors have announced their intention to appeal the two not-guilty verdicts.

Defending the fairness of the split verdict, the court cited the ancient maxim “刑無等級 趣物而不兩” (“Punishment knows no rank; the law applies to all things equally”), asserting that the rule of law must be applied without exception or discrimination, regardless of the defendant’s former position of power.

The ruling comes amid a series of trials stemming from investigations into former president Yoon Suk Yeol’s short-lived declaration of martial law in 2024 and subsequent scandals.
