Jurist Rights group says 2 Israel attacks against civilians in Lebanon must be investigated as war crimes

Two Israeli attacks in Lebanon between September and November 2024 appear to be indiscriminate attacks against civilians to be investigated as war crimes, Human Rights Watch (HRW) confirmed on Wednesday.

HRW suggests the two Israeli strikes on the town of Younine are evidence of the failure of Israeli forces to distinguish military targets from civilians. The first attack in Younine occurred on September 25, killing 23 people. The second strike took place on November 1, causing the death of ten people. In total, 15 children were killed during the attacks. The evidence collected by HRW allegedly indicates no military activity in these sites.

Lebanon researcher at HRW, Ramzi Kaiss, said, “More and more evidence is emerging that Israeli forces repeatedly failed to protect civilians or adequately distinguish civilians from military targets during its strikes across Lebanon in 2023 and 2024”. Kaiss claims the Lebanese government should ensure justice for the victims. To achieve this, HRW recommends giving the International Criminal Court (ICC) jurisdiction to investigate and prosecute crimes in Lebanon.

Lebanon is not a member of the Rome Statute. Despite this, States can grant the ICC jurisdiction to investigate and prosecute crimes in their territories through a declaration. Lebanon took major steps towards accepting the ICC’s jurisdiction in April 2024, allowing the Foreign Affairs Ministry to submit a declaration. Still, in May 2024, the Lebanese government withdrew its request amid fear this would grant the ICC power to investigate other sensitive matters.

Israel completed several attacks against Lebanon, in violation of the ceasefire agreement between Israel and the armed group Hezbollah. The UN Office of the High Commissioner for Human Rights (OHCHR) recently expressed serious concerns over violations of international humanitarian law in Lebanon. HRW confirmed that between October 2023 and December 2024, Israeli attacks killed more than 4,000 people in Lebanon. Moreover, due to the escalation of hostilities, the UN Office for the Coordination of Humanitarian Affairs (OCHA) established that more than 961,000 people remained displaced in Lebanon.

International humanitarian law seeks to protect civilians from the dangers of military conflicts. Indiscriminate attacks against the civilian population may constitute war crimes, to be investigated under international law.

Rights groups like Amnesty International have already stated that Israel shall be investigated for war crimes for attacks against healthcare facilities in Lebanon. UN Secretary-General António Guterres also claimed that the attack by the IDF against UN personnel may constitute a war crime.
