The Pakistan Supreme Court upheld Saturday the Election Commission of Pakistan (ECP) order revoking the “cricket bat” election symbol of former prime minister Imran Khan’s Pakistan Tehreek-e-Insaaf (PTI) party, one of Pakistan’s three major opposition parties. ECP revoked the symbol due to the alleged failure of PTI to hold intra-party elections.
The Supreme Court found that PTI failed to provide prima facie evidence of holding intra-party elections and criticized PTI’s dismissal of complaints. The court upheld ECP’s authority to question and adjudicate intra-party elections and set aside the PHC’s order, affirming ECP’s decision to declare PTI ineligible for an election symbol.
The case involves ECP directing PTI to conduct intra-party elections, as mandated by the Elections Act, 2017. PTI, citing the COVID-19 pandemic, had sought an extension but was granted a deadline of June 13, 2022, with no further extension promised. PTI claimed to have held elections on June 8, 2022, but the ECP, in a September 13, 2023 order, declared them non-transparent and instructed PTI to conduct elections within 20 days.
PTI challenged the ECP’s order in the Peshawar High Court (PHC). PHC directed the ECP to decide by December 22, 2023, resulting in the ECP declaring PTI ineligible to obtain an election symbol. This decision was challenged in PHC, which was allowed on January 10, 2024.
Former PTI chairman and leader Gohar Khan expressed his perspective on the situation, stating, “Disappointment with the Supreme Court’s decision today – justice should be seen to be done. Today there is a new addition to the chapter on controversial decisions.”
Furthermore, the Lahore High Court Bar Association strongly criticized the Supreme Court’s decision in a press release. They argued, “The Constitution of Pakistan gives all political parties the right to participate in elections.” The Bar Association officials accused the judiciary of attempting to hinder PTI’s electoral participation, alleging a lack of a level playing field and asserting that the Election Commission is neglecting its constitutional powers. They expressed concerns that such actions jeopardize the possibility of conducting a fair and transparent election.
The PTI party is facing numerous setbacks as the upcoming general elections approach. Its leader, Khan, was recently convicted in the Toshakhana corruption case, accused of selling state gifts. Furthermore, the ECP also rejected a slate of PTI nominations for the general elections, including Khan’s from two constituencies. However, some of these rejections have been overturned in appeals, excluding the appeal by Imran Khan, which the concerned Tribunal dismissed.
