The Court of Appeals in Belfast on Friday dismissed an appeal challenging Prime Minister Boris Johnson’s Brexit strategy.
The concern by one of the applicants, Raymond McCord, was that the the Brexit strategy would destroy the Northern Ireland peace agreement. The court stated that it was not the correct venue for deciding such matters, as Parliament has an opportunity to appeal the plan.
“Ministers are, of course, subject to questioning in Parliament about the negotiations and secondary legislation facilitating withdrawal is subject to scrutiny. Parliament will have the opportunity to vote on the outcome of the negotiations.”
The court concluded that an assessment of the Brexit Strategy would involve political analysis by the court. This, the court said, would not be appropriate, as it would violate the governmental structure of the UK, as well as separation of powers principles.
