Jurist Nigeria urged to act urgently to protect abducted victims

Human Rights Watch (HRW) on Tuesday urged the Nigerian authorities to take urgent measures to secure the release of victims of a recent mass school abduction. HRW denounced the mass abduction of hundreds of students and teachers in Nigeria’s northwest and central regions, describing them as deliberate attacks on education and fundamental rights.

HRW’s Nigerian researcher Anietie Ewang stated:

These mass school kidnappings once again lay bare the deliberate targeting of students, teachers, and schools in Nigeria’s deteriorating security environment… Children in Nigeria have the right to go to school without fearing for their lives. Nigerian authorities should prioritise the safe release of the kidnapped children and their teachers and bring those responsible for their abduction to justice.
The group further called for the immediate release of all abducted individuals and concrete steps to prevent further attacks. While the Nigerian authorities have shut down certain schools or restricted their activities, HRW contended these were inadequate measures that deny children access to education and psychological support at schools. The researchers urged the government to adopt concrete measures to prevent the risk of academic underperformance and long-term developmental setbacks.

In response to the recent abduction, President Bola Tinubu has ordered security agencies to act swiftly to bring back the victims and encouraged the local communities to share information and intelligence that will aid the military.

Under Nigeria’s domestic law, the Child Rights Act 2003 guarantees children’s right to education and protection from abduction, trafficking, and exploitation. Moreover, section 371 of the Criminal Code Act prohibits the kidnapping and abduction of children, which can be punished by imprisonment for fourteen years. On the international foray, Nigeria has obligations under the Convention on the Rights of the Child to safeguard children from abduction and violence. The country has also ratified the Safe Schools Declaration (2015) to protect education during armed conflict.

On November 18, unidentified armed men kidnapped 25 schoolgirls from the Government Girls Comprehensive Secondary School in Maga, Kebbi State. Just three days later, another 303 students and 12 teachers were abducted from St. Mary’s Catholic Primary and Secondary School in Papiri. 50 of the 303 children have since escaped bondage, according to the Christian Association of Nigeria.

The latest incident is similar to the 2014 and 2015 abductions allegedly carried out by the Boko Haram armed group, the victims of which are still missing. As HRW highlighted, this demonstrates a pattern of violent attacks and kidnappings reportedly carried out by criminal gangs for ransom, which has plagued the country in recent years.

Previously, UNICEF also condemned the abduction of 25 students, urging those responsible for the incident to be held accountable. In September, a UN committee found the Nigerian authorities responsible for “grave and systematic violations” of the rights of women and girls over the 2014 abduction of schoolgirls by Boko Haram.
