Jurist Kenya victims of abduction call for ICC investigation

Victims in Kenya urged the International Criminal Court (ICC) on Sunday to investigate alleged cases of abduction amid a rise in human rights violations across the country.

The Kenya Human Rights Commission (KHRC), together with other local human rights organizations and several victims of enforced disappearances signed a petition demanding the ICC to investigate alleged cases of state persecution. The KHRC accused the Kenyan government of extrajudicial killings, police brutality and other instruments of oppression. The claim is that these attacks against civilians amount to crimes against humanity, prohibited under Article 7 of the Rome Statute.

Several victims and survivors of enforced disappearances in Kenya talked about their experiences at a press conference. Bob Njagi and Aslam Longtom were two of the victims of recent abductions. They stated that they “were subjected to torture by security agents simply for advocating progressive economic reforms and better governance”. In the conference speakers also claimed that “Kenya’s justice system has failed to investigate and prosecute these violations”.

At present, Kenya is facing a surge in human rights violations. The Kenyan National Commission on Human Rights (KNCHR) recently stated its concerns, citing cases of enforced disappearances targeting and intimidating human rights defenders. The KNCHR also urged government action regarding police brutality to ensure the right to freedom of expression of Kenyan citizens. In a press release, the KNCHR noted that “enforced disappearances cannot and must not be normalized in Kenya. The government must adhere to its constitutional obligations under Article 238 to ensure the safety of every individual within our borders”.

Several other human rights organizations have also called on the government to release unjustly detained individuals. Organizations like Human Rights Watch (HRW) reported the failures of the Kenyan government to investigate and ensure justice for arbitrary detentions and police brutality. In its report released in November 2024, HRW recalled justice had not yet been delivered for victims of the 2023 protests in Kenya, as the responsible actors had yet to be held accountable.
