Jurist Jordan forcibly evicts Palestinian refugees for urban development projects

Human Rights Watch (HRW) reported Tuesday that Jordanian authorities forcibly evicted and demolished residences in an informal Palestinian refugee camp in Amman without following proper procedures, as part of an urban development project. The project’s stated goals include improving living conditions, managing urban growth, and recovering the costs of upgrading and expanding infrastructure facilities through land sales and tariffs paid by residents.

The development project displaced dozens of residents from the al-Mahatta camp. The government failed to comply with international legal standards, including providing adequate notice, meaningful consultation, and fair compensation. Eight displaced residents told HRW that they were given only two weeks to one month’s notice and vague, verbal promises of compensation, with little transparency regarding the process or timeline.

The group argued that these failures constitute a violation of residents’ human rights, including the rights to housing, education, and an adequate standard of living. Adam Coogle, deputy Middle East director at HRW, added:

Displacing families and cutting off livelihoods without proper safeguards and a fair compensation process leaves scores of people with few places to turn for help. Jordanian authorities should prioritize the rights of residents when considering infrastructure projects and ensure that no one is left without adequate housing or other fundamental rights.
According to the UN Human Rights Council, protecting the right to an adequate standard of living requires states to provide appropriate notice to all potentially affected persons, timely dissemination of relevant information, sufficient time for public review, access to legal and technical assistance, and the holding of public hearings.

Moreover, international guidelines specify that states must provide fair and just compensation for all losses, including personal and real property, goods, and property-related interests. HRW emphasized that the compensation proposed in this case did not meet these standards. Mayor Shawarbeh responded to concerns about the inadequacy of compensation by asserting that the residents were “encroaching on state land,” and thus were not entitled to compensation. He characterized the government’s offer as a “donation” rather than compensation.

Lastly, international law prohibits forced evictions regardless of legal ownership or tenure status. Victims of forced evictions must be provided with adequate compensation and access to effective remedies. In response to the evictions, Coogle urged Jordan to provide “speedy and effective remedies” to residents, especially those economically disadvantaged.

Notably, the right to adequate housing is guaranteed by Article 11.1 of the International Covenant on Economic, Social and Cultural Rights, to which Jordan is a state party.
