Israeli Prime Minister Benjamin Netanyahu on Saturday said that the bodies of three Israeli hostages were recovered from Gaza. Netanyahu stated that the Israeli Defense Forces (IDF) and Shin Bet, the country’s internal security agency, managed to successfully bring back the bodies of Yonatan Samarno, Sergeant Shai Levinson and Ofra Keder.
According to the IDF, Kedar and Samarno were “brutally murdered and kidnapped” by Hamas on October 7 in a Kibbutz, an Israeli communal settlement while Levinson was killed fighting Hamas.
The Hostages and Missing Families Forum expressed condolences to the families of the hostages, adding that all hostages must be brought home as they “have no time.” In a post on Instagram, Samerano’s father thanked the IDF and the Israeli government for bringing his son’s deceased body back “on the very day he was born.”
Article 34 of the Fourth Geneva Convention prohibits the taking of hostages in situations of armed conflict. Violations of the provision may constitute war crimes under the Rome Statute of the International Criminal Court (ICC). Common Article 3 of the Geneva Convention (1949) states that persons “taking no active part in the hostilities” should be treated humanely in “all circumstances,” outlawing the taking of hostages.
Similarly, Article 8(2)(a)(viii) of the Rome Statute of the ICC criminalizes taking of hostages during armed conflict, defining it as a war crime, while Article 8(2)(c)(iii) applies it similarly to non-international conflicts.
Hamas took 251 hostages during the Nova Festival attack on October 7, 2023, with at least 30 believed to be dead, and killed over 1,200 people. In 2024, the ICC issued several arrest warrants for war crimes and crimes against humanity, including several Hamas military leaders.
