Human Rights Watch (HRW) called on the new Lebanese government to adopt a human rights oriented agenda that promotes the rule of law, transparency and accountability on Thursday. The organization urged the government to implement legal reforms across various sectors to meet the needs of the people and build a brighter future for the country.
In a letter to newly appointed Prime Minister Nawaf Salam, HRW provided ten recommendations to guide the Lebanese government in addressing the country’s challenges. These recommendations touch on multiple areas, including accountability, judicial independence, the socio-economic sector, freedom of expression and human rights.
HRW urged the government to enact new laws that enhance judicial independence and end political interference in judicial investigations, which according to the organization, created a culture of impunity and diminished public trust in the judicial system. For this purpose, HRW called on the Lebanese government to reform Article 751 of the Code of Civil Procedures, Article 52 of the Code of Criminal Procedure to align with international standards on judicial independence which are outlined in the European Commission for Democracy through Law’s recommendations for Lebanon and the United Nations Basic Principles on the Independence of the Judiciary.
Relatedly, HRW highlighted the previous political obstacles that impeded the official investigation into the 2020 Beirut blast. The organization stated that the current government should take all necessary measures to allow the inquiry to proceed, including removing the immunity of public officials. Furthermore, HRW recommended the ratification of the Rome Statute to enable the International Criminal Court to investigate war crimes that have occurred on Lebanese territory since October 2023.
HRW also stressed the urgent need for the government to address the ongoing economic crisis that has increased the people’s poverty and to improve the performance of public administrations. To this end, the rights organization called on the government to implement measures that improve governance and establish transparent, corruption-free public institutions that function effectively.
Lastly, HRW urged the incoming government to enact a series of measures to enhance the human rights situation in Lebanon, particularly concerning refugee rights, freedom of expression, and women’s rights. The organization asserted that the Lebanese government should improve its treatment of Syrian and Palestinian refugees by halting forced returns and reviewing domestic laws that prevent refugees from working in certain professions. HRW also called for aligning the country’s criminal defamation laws with the United Nations Human Rights Committee’s General Comment on Article 19 of the International Covenant on Civil and Political Rights (ICCPR). Moreover, the organization urged the government to reform discriminatory laws against women related to marriage, divorce, nationality, and freedom of movement, as well as to adopt legislation that protects women from abuse.
Following the election of President Joseph Aoun on January 9, 2025, the Parliament of Lebanon nominated Nawaf Salam as Prime Minister. He is tasked with forming a government that must receive a vote of confidence from Parliament to function. The new Lebanese government will face several pressing issues, including the refugee crisis and the economic crisis that has plagued the country since 2019, depriving Lebanese citizens of basic rights such as healthcare, access to electricity, and income security.
