UN Special Rapporteurs Reem Alsalem and Ai Kihara-Hunt said Monday in a joint statement that they have received reports of children in France who allege sexual abuse by a father still being ordered into visitation with that parent during criminal investigations, and of mothers who resist such orders facing prosecution or restrictions on their parental authority.
Alsalem, the UN Special Rapporteur on violence against women and girls, its causes and consequences, and Kihara-Hunt, the UN Special Rapporteur on the sale, sexual exploitation and sexual abuse of children, did not name a statute, but the prosecution risk they described is non-représentation d’enfant: a mother who refuses a visitation order over abuse concerns can be prosecuted for failing to present the child while the allegation is still under investigation.
France’s own rights ombudsman separately told a National Assembly inquiry commission on incestuous sexual violence and protective parents, which closed in July, that recent legislative changes have already limited such prosecutions and eased modification of the other parent’s rights, but that these parents remain in what she called “profound legal insecurity.”
A European Court of Human Rights (ECtHR) ruling in April 2025 found France had failed to protect three minors who reported rape, faulting French courts for not properly weighing the children’s vulnerability or ability to consent. In November 2025, France enacted a law that redefined rape and sexual assault around consent, following a public reckoning after the mass rape trial of Dominique Pelicot and 50 co-defendants.
Despite these steps, the experts said they continue to receive “troubling allegations … concerning the absence of immediate protective measures in certain cases involving alleged sexual violence.” They also cited reports that obstacles to filing complaints delay investigations and the safeguards that are supposed to follow. “When credible allegations of child sexual abuse are raised, authorities must ensure that the best interests of the child remain the primary consideration in all administrative and judicial decisions,” Alsalem and Kihara-Hunt said.
A bill that passed the National Assembly in January would let a prosecutor act within 72 hours and a judge rule within 15 days on a provisional protection order barring an accused parent from contacting a child during an investigation; it is now pending in the Senate.
