Former French Prime Minister François Fillon received a suspended sentence of four years in prison on Tuesday for the embezzlement of public funds, according to local media. The appeals court further ordered him to pay a fine of 375,000 euros and ruled him ineligible to run for public office for the next five years.

Fillon was found guilty in 2020 of having created a fictitious parliamentary assistant position for his wife, Penelope Fillon. The scandal was first reported in 2017 by Le Canard Enchaîné, when Fillon was running as the presidential candidate for Les Républicains. Penelope Fillon was paid significant amounts in public funds despite not working at the National Assembly. He was initially sentenced to five years in prison, three of which were suspended. His wife was also sentenced to a three-year suspended prison sentence.

In May 2022, the court of appeals reduced Fillon’s sentence to one year in prison and a three-year suspended sentence, in addition to 10 years of ineligibility for public office. This sentence was partially annulled by the Court of Cassation in 2024, which decided that a year in prison was “insufficiently motivated.” The court ordered a resentencing, leading to Tuesday’s decision.

Fillon’s lawyer, Antonin Lévy, said that the decision “has put this matter in its rightful place. There is no jail time, no electronic bracelet. François Fillon is a free man.” He further stated that he would consider an appeal.

This decision follows numerous sentences given to other prominent political figures in France. Former President Nicolas Sarkozy is currently on trial for allegedly receiving campaign funds from the former Libyan leader Muammar Gaddafi. Marine Le Pen, former leader of the National Rally, is appealing a conviction for embezzlement, which prevents her from running for president for the next five years.
