Jurist Former EU top diplomat accused in fraud investigation

Former European Union Commission Vice President and foreign policy chief Federica Mogherini was formerly accused on Wednesday of procurement fraud and corruption, conflict of interest, and violation of professional secrecy, the European Public Prosecutor’s office (EPPO) revealed in an online statement.

Mogherini and two other high-profile suspects were detained as part of a bigger fraud probe conducted by the EPPO. It included searches of the elite diplomatic university, the College of Europe, the European foreign policy headquarters, the EEAS, and the houses of the suspects. Their immunities under EU Law, specifically Protocol (No 7) on the privileges and immunities of the European Union, were lifted by the EPPO.

Having served as the EU’s high representative for foreign affairs from 2014 to 2019, and after a brief period as Italy’s foreign minister, Mogherini went on to become rector of the College of Europe. Located in Bruges, it is a postgraduate university that serves the education of prospective EU diplomats. The accusations focus on suspected fraud in relation to the 130,000 euros funding of a training for junior diplomats. Prosecutors suspect that the college, with Mogherini as the rector in 2021-2022, broke EU tendering rules in securing the funding since:

[The] College of Europe and/or their representatives were informed in advance about the selection criteria of the tender procedure and had sufficient reason to believe that they would be awarded the implementation of the project, prior to the official publication by the EEAS of the tender notice.
EU public funding contracts are usually awarded through a competitive procedure, public tendering, where applicants compete fairly among each other to secure Union funds. By circumventing this process, the EPPO suspects that Article 169 of the Financial Regulation related to fair competition, was breached, and that confidential information related to the ongoing procurement was shared with the institution.

Mogherini issued a statement expressing her trust in the justice system and that “in its long tradition, the College has always applied and will continue to apply the highest standards of integrity and fairness.” On Thursday, Mogherini resigned as Rector of the College of Europe.

Current EU Commission vice president Roxana Mînzatu told a media outlet that she was “absolutely shocked” about the event, and called on the independent investigators to carry out their work to defend the public trust in the EU as an institution.
