Jurist Ex Serbian policeman faces retrial in Croatia for alleged war crimes

Former Serbian policeman Milenko Maric will be re-tried in Osijek, Croatia for alleged war crimes against the civilian population after his extradition from the UK in accordance with the Extradition Act 2003. Maric’s trial will begin on Tuesday for alleged crimes contrary to article 120(1) of the Basic Penal Law of the Republic of Croatia, including assaulting civilian detainees. Maric was previously tried in 2017 but was acquitted. However, the Croatian Supreme Court found there was “significant procedural violation” and overturned the verdict.

The retrial comes after Maric lost an eight year long appeal against his extradition and European arrest warrant. The warrant alleges that Maric was a member of a militia, “the Secretariat for International Affairs of Beli Manastir” which assaulted detained civilians of non-Serbian ethnicity. He was arrested in England in 2015 for purposes of the European arrest warrant, where he was residing. His extradition was ordered in 2022 at Westminster Magistrates Court.

The trial will commence on Tuesday. Maric denies the allegations and asserts that he “only did good things” during his time in the war. Maric’s defence lawyer asserts his rights are violated as he was sent to the incorrect prison to await trial. The maximum sentence for the offence under Croatian law is 20 years’ imprisonment.
