Cuba revoked parole and arrested prominent dissidents Jose Daniel Ferrer and Felix Navarro on Tuesday. Cuba’s Supreme Popular Tribunal, Cuba’s highest court, announced in a statement that Ferrer and Navarro had violated parole conditions and therefore must return to prison.

Maricela Sosa, vice president of the Supreme Popular Council, cited Article 149 of Law No. 152 of 2022 on Penal Enforcement, saying that the court can revoke conditional release if a convicted person violates established obligations.

Ferrer had been convicted of unlawful deprivation of liberty and assault and has now been arrested for failing to attend court summons as required by his parole. Ferrer had announced on social media that he would not appear, maintaining that he had been wrongfully jailed from the start and therefore did not need to attend a judicial hearing. Ferrer’s sister, Ana Belkis Ferrer, said on social media that her brother and his wife and son had been detained by police early on Tuesday.

Navarro had been convicted of public disorder, contempt, and assault. After release, he left the municipality seven times without court permission. Sosa cited Article 135 of the Penal Enforcement Law Regulations, saying that the law forbids a supervised person from travelling to another territory without judicial authorization.

In response, the US State Department condemned the arrest and called for the activists to be released. “We strongly condemn the brutal and unjust detention of Cuban patriots Jose Daniel Ferrer and his wife and young son, as well as Felix Navarro and other pro-democracy activists,” spokesperson Tammy Bruce told reporters.

Ferrer and Navarro were among 75 opposition members arrested in March 2003 in a period known as the “Black Spring“, when they were charged with working with a foreign power. Later that year, Ferrer founded UNPACU, or the National Patriotic Union. He was arrested again in a crackdown on mass protests in July 2021.

After discussions mediated by the Vatican in January this year, Cuban President Miguel Diaz-Canel released 553 prisoners, including Ferrer, Navarro, and 229 others considered political prisoners by rights groups. The outgoing Biden administration had promised in return to loosen sanctions and remove Cuba from a list of state sponsors of terrorism.

Amnesty International designated Ferrer and Navarro as prisoners of conscience. Ana Piquer, Americas director at Amnesty International, said that the designation was “a recognition of the dozens of people who remain in prison in Cuba for peacefully exercising their rights, and of all those who live under constant surveillance, harassment, and the threat of criminalization.” Piquer further noted that the Cuban state “seems intent on eradicating any capacity for resistance within Cuban society, which now extends to projects, spaces and activism not linked to traditional political opposition or dissidence.”
