Amnesty International on Friday voiced concern over the possible closure of the Special Criminal Court (SCC) in the Central African Republic due to a lack of funding.
The rights group stated that it would lead to a catastrophic blow to prospects of thousands of victims and survivors in securing justice for serious crimes committed over two decades of conflict in the country. They added that despite the authorities’ efforts, national courts still lack the resources and capacity to assume the SCC’s work.
Marceau Sivieude, Amnesty International’s regional director for West and Central Africa, in a call for support stated:
The SCC was established in 2015 by a law passed by the National Assembly of the Central African Republic (CAR) with a mandate to prosecute, under international law, the most serious crimes committed in the CAR since 2002 – particularly war crimes, crimes against humanity, and other serious human rights violations. As a “hybrid court” it is staffed by both international and Central African judges and prosecutors, with the aim of broadening the scope of individuals that can be held to account beyond what the ICC, a court of last resort, would handle.

Previously, violence in the CAR had led to two separate International Criminal Court (ICC) referrals to investigate war crimes and crimes against humanity that occurred during periods of conflict. ICC investigations began in May 2007, leading to the Bemba case that established precedents for the ICC on war crimes, and crimes against humanity, and the principle of complementarity. However, both ICC investigations closed in 2022, leaving the SCC as the only court that could provide redress to victims of war crimes.We call on the African Union, the European Union and their respective member states, as well as all other State partners, to step up with sustained financial and human resources support so the SCC can continue its vital work in the Central African Republic.
